All disputes arising out of the agreement or services provided hereunder shall be subject to mandatory binding arbitration through Arbitration Service of Portland venued in Portland Oregon before a single arbitrator with mediation a condition precedent to filing for arbitration. The prevailing party in any such action shall be entitled to recover from the non prevailing party reasonable attorney fees, arbitration and mediation fees (filing fees and costs of the mediator and arbitrator) and costs incurred.
